Hindu Marriage is invalid without Rituals: Allahabad HC PTI
The court cited Section 7 of the Hindu Marriage Act, 1955, which states that a Hindu marriage can be conducted following the customary rituals and ceremonies of either party involved.
The Allahabad High Court, noting that a Hindu marriage lacks validity without the ‘Saptapadi’ ceremony and other rituals, has dismissed a case where a man accused his estranged wife of entering into a second marriage without divorcing him. Justice Sanjay Kumar Singh, in response to a petition from Smriti Singh, stated, “It is firmly established that ‘solemnize,’ in the context of marriage, refers to celebrating the marriage with appropriate ceremonies and in the correct manner. Unless the marriage is celebrated or conducted with proper ceremonies and due form, it cannot be considered as solemnized.”
